This blog is not abandoned
This blog is not abandoned. I have been so busy with school and work I have not had the time to write in here.
To anyone who doubted Judge Roberts, please read his disent he just wrote on searches. While I understand the idea that one person can not surrender the constitional rights of another, I must say I agree with Judge Roberts. Here is my scenario, what happens if the police are called out on a domestic disturbance call and the female tells the officers that her husband threatened her with a knife. Now, with the new ruling the usband can say, no I didn't. The officers then ask for permission to search the residence and the husband says no, all evidence is lost and the case is droped.
The Court should have made a ruling in effect upholding all "related evidence" that would have solved the problems.
Any Comments??
